ST KILDA FOOTBALL CLUB LIMITED "LOTTO SYNDICATE" PROMOTION TERMS & CONDITIONS
1.Information on how to enter the St Kilda Football Club Lotto Syndicate promotion (“Promotion”) and claim prizes form part of these Conditions of Entry. By participating in the Promotion, entrants are deemed to have carefully read, fully understood, and agreed to these Conditions of Entry.
2.Entry in the Promotion is open to residents of Victoria who are 18 years of age or over. The offer to the entrant to participate in this Promotion by the Promoter is made in Victoria and any acceptance by the entrant is deemed to be in Victoria and accordingly these Conditions of Entry are governed by the laws of Victoria.
3. The Promoter reserves the right:
(a) to verify the validity of entries, claims and entrants and to disqualify any entrant who tampers with the entry/claim process or who submits an entry/claim that is not in accordance with these Conditions of Entry;
(b) to conduct security verification checks in its absolute discretion; and
(c) to request entrants to provide proof of age, personal details and identity prior to awarding any prize. Identification considered suitable for verification is at the discretion of the Promoter. Failure to enforce any of these rights, at any stage, does not constitute a waiver these rights.
4. Multiple entries into the Promotion are accepted, but each entry must be associated with a separate donation payment. No responsibility is accepted for late, lost or misdirected entries or correspondence. The Promoter will not be liable for any lost or misdirected mail nor will the Promoter be liable if the entrant does not receive any payments due to the entrant as a result of incorrect information provided by the entrant to the Promoter.
5.In order to be eligible to enter the Promotion, the entrant must make the requisite donation of $2 per week, which can be made in the following payment options only: (i) $26 (13 weeks), (ii) $52 (26 weeks), or (iii) $104 (52 weeks).
6. To enter the Promotion, the entrant must either:
(a) complete the application form, and either fax to 03 9637 7077 or mail to: StKildafc “Lotto Syndicate” Promotion, Suite 11, 210 Toorak Road, South Yarra, 3141;
(b) visit www.saintslotto.com.au and complete the application form online; or
(c) visit www.saintslotto.com.au and download a copy of the application form. The entrant must then complete the application form and either fax to 03 9637 7077 or mail to: StKildafc “Lotto Syndicate” Promotion, Suite 11, 210 Toorak Road, South Yarra, 3141.
7. Payments made by money order, and cheques must be sent to StKildafc “Lotto Syndicate” Promotion, Suite 11, 210 Toorak Road, South Yarra 3141. Money order and cheques must be made out to Loyalty Marketing Pty Ltd, who is collecting payment on behalf of the St Kilda Football Club Limited. Payment in the form of money order and cheques must be for a minimum payment of $52 for 26 weeks (that is, $2 x 26 weeks = $52). Entrants who register their credit card details as the payment method will have a further $26 (13 weeks), or $52 (26 weeks) or $104 (52 weeks), depending upon their initial donation option, processed automatically once the initial period has lapsed, for such further similar periods thereafter, until explicit instructions to cancel their participation is received by the Promoter in writing or over the phone, by calling: 1300 721 123, 9 – 5pm weekdays. Credit card payments will be identified on entrant’s bank statements as “loyalty.com.au” who are also Loyalty Marketing Pty Ltd.
8. Promotion commences 01/02/2010. Entries (in a lotto syndicate for the weekly Saturday Night Draw run by Tattersalls) close 1.30pm on each Friday, until the Promotion is terminated by the Promoter. The Promotion may be terminated by the Promoter at any stage with 4 weeks notice by publishing a notice at www.saintslotto.com.au. If the Promotion is terminated, the individual will still receive any outstanding syndicate entries in the Saturday Night Draws run by Tattersalls which they were originally entitled to. For the sake of clarity, if the Promotion is terminated and the entrant still has 10 weeks of entitlements to syndicate entries, then they will still receive those 10 weeks of entitlements, but will not be able to make additional donations to receive further entitlements.
9. On the Friday following the processing by the Promoter of a valid entry by an entrant, the entrant will be grouped in a syndicate of five (5) by the Promoter. The entrant will receive the same five (5) lines of six (6) numbers per week, in a syndicate lotto entry with four (4) others, for the period equivalent to the number of weeks of their donation (i.e. 8, 26 or 52). This period will start from the date their entry is processed and donation payment is received by the Promoter, and not from the date the application form is received. These numbers will be sent to the entrants via email. The agent of the Promoter will then enter the syndicate’s lines in the weekly Saturday Night Draw run by Tattersalls. These five (5) separate lines of six (6) numbers in the Saturday Night Tattersalls Lotteries are free of charge to the entrant. In the event there are not enough participants to fulfill a full syndicate consisting of 5 people, the entrant will be placed into the next full syndicate to receive their 5 lines of lotto.
10. In addition, Supporters may also nominate up to 5 friends who they think would like to donate by completing their friend’s name and email address on the donation form. An email will be automatically forwarded to the friend inviting them to donate to the StKildafc. The operation of the referral mechanic is subject to the Spam Act 2003. Each friend may only be referred once during the promotional period and Supporters who have already entered cannot be referred as friends by a subsequent entrant. If the validly referred friend subsequently donates, then the original entrant who nominated them will receive an additional entry into the fortnightly prize draw for every entry that the referred friend receives for the remaining promotional period.
11. Any entrants who have numbers, in one of their five (5) lines of numbers, that match the first six (6) numbers drawn in the specified lotto draw will each win a one fifth (1/5) share of the winnings allocated to that syndicate in the division one pool in that lotto draw. Any entrants whose numbers, in one of their five (5) lines of numbers, match the numbers drawn in the specified lotto draw in accordance with the ordinary lotto rules for winning number combinations for divisions two (2) to five (5) will each win a one fifth (1/5) share of the relevant prize allocated to that syndicate (for division 2, 3, 4 or 5). The prize money will be paid to the Promoter and will then be distributed by cheque and mailed to the members of the winning syndicate within 28 days from the winning week. The payment will only be made once the prize money accumulates to a minimum amount of $20. In the event that the total prize money accumulated by an entrant over a 12 month period is less than $20, the accumulated prize money will be retained and distributed at the end of the entrant’s entry. The Promoter reserves the right to pass on to the entrant any fees, costs, charges, taxes, imposts, levies or duties the Promoter or its agent incurs in transferring monies to the entrant and the entrant hereby authorizes the Promoter to debit such amounts from monies due to the entrant.
12. Only the entrant named on the promotional syndicated lotto entry submitted for verification will be recognised as the owner of any interest in that syndicated lotto entry. The Promoter accepts no responsibility for variation in the value of the lotto prize pool.
13. Promoter’s decision is final and no correspondence will be entered into.
14. Tattersall's has no involvement in the Promotion and any claims for prizes arising out of the Promotion are between the entrant and the Promoter.
15. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for personal injury which is suffered or sustained, as a result of taking any of the prizes, except for any liability which cannot be excluded by law.
16. The Promoter is not responsible for any incorrect or inaccurate information, either caused by website users or by any of the equipment or programming associated with or utilised in this Promotion, or by any technical error that may occur in the course of the administration of this Promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries and to the extent that such liability cannot be excluded by law, we will not be liable for any direct, indirect, incidental or consequential loss, loss of a chance, damage, expense or claim arising out of such error, omission or inaccuracy. Any costs associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
17. The Promoter collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, or disclose it to other organisations that may use it, in any media, for an indefinite period, for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages and telephoning the entrant. Entrants’ personal information may be disclosed to the Victorian Commission for Gambling Regulation and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
18. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
19. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
